⏲️ 5-Hour Energy Feels Growing Pains

Armed with one of the most recognizable IPs in the RTD energy space, 5-Hour Energy boldly leapt from 2 oz. shots to a full-size RTD in 2021, fully intent on establishing a foothold in the category. Yet its experience moving from convenience store counters to coolers has not played out as easily as it might have imagined, we learned during a recent discussion with 5-Hour President and COO Jeff Sigouin.

One of the main challenges in the beginning was finding the right mix of distributors to carry the 16 oz. drinks. Aiming “for a street fight with DSDs,” 5-Hour initially targeted independent c-stores via independent beer wholesalers to distribute and merchandise the drinks in-store, but the approach stuttered. Some distributors left the brand, asking for more chain store listings before they would carry the product again, Sigouin said. 

That response compelled the brand to spend the time working out the kinks, reformulating the drinks for a bolder flavor profile and trying to recruit NA-focused distributors - including Arizona legend George Kalil - and its own street team of sales reps to promote in-store. While still gaining a foothold in independent convenience stores (around 4,000 so far), the company is also finding some success pursuing grocery chains. The six-SKU line is now available with about 40 retail chains including select H-E-B, Meijer, Tops Friendly Markets and Publix.

Growth may not be as rapid as expected, but 5-Hour is committed to making the cans work at retail, with the company hinting at the reveal of new innovation and packaging at this week’s NACS trade show in Atlanta. Next up: signing on another “60 to 80” distributors to add to the roughly 180 partners accumulated thus far. 

“We learned from our failures, and we also learned that the environment was rapidly changing. It was different than we thought it was when we first entered,” Sigouin said.

Liquid Death has named Stephen Ballard, former SVP of Sales at The Mike’s Hard Lemonade Company, as its first Chief Commercial Officer.

👷‍♂️ Ballard began in the role this week and he will oversee field sales, distribution, national accounts and international expansion. He will report directly to Liquid Death co-founder and CEO Mike Cessario.

🍻 While it has no intention of hopping into the alcohol space, Liquid Death often behaves more like a beer company than a non-alc brand, Cessario told us. That makes Ballard’s 25+ years of experience in the alcohol sector valuable as the brand continues to expand with its omnichannel strategy.

We all read past the fine print sometimes, but when it comes to agreements between distributors and suppliers, the devil is in the details. 

As the categories get increasingly blurry, Sovos invited three beverage alcohol lawyers – Shauna Barnes of Barnes Beverage Group, Elke Hofmann of Elke A Hofmann Law, and Arielle Albert of Danow, McMullan & Panoff – to the Sovos Beverage Alcohol Summit last week to talk about the biggest wholesale agreement pitfalls. 

🔮 Manage expectations! Is the wholesaler’s selling styles aligned with an off-premise or on-premise focus? If the distributor is focused heavily off-premise, will the supplier have the capacity to sell into chains? Asking the right questions, and managing expectations, can help swerve pitfalls.

🚩 But beware of red flags, sometimes in the form of a “really supplier-friendly” contract that allow for supplier termination at any time, according to Hofmann. Franchise laws could trump those terms.
